These Terms of Service (“Terms”) govern your access to and use of MailMex, including its websites, campaign tools, Gmail integrations, rendering features, and related services (collectively, the “Service”). By using the Service, you agree to these Terms.
1. Eligibility and authority
You must be legally able to enter into a binding agreement and at least 18 years old, or the age of majority where you live. If you use MailMex for an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
2. Accounts and connected services
You must provide accurate account information, protect your credentials and devices, and promptly report suspected unauthorized use. You are responsible for activity under your account.
When you connect Gmail or another third-party service, you authorize MailMex to access and use that service only as needed to perform the actions you request. Third-party services are governed by their own terms, policies, quotas, and availability. You may revoke access, but relevant MailMex features may then stop working.
3. The Service
MailMex provides task-based campaign preparation, recipient import, personalization, browser-side document rendering, Gmail delivery controls, and campaign-status features. Features may change, be limited, or be discontinued. Your browser and device may need to remain active while browser-powered work is running.
4. Your sending responsibilities
You—not MailMex—are the sender of messages transmitted through accounts you connect. You are responsible for:
- Having a lawful basis and all required consent to contact every recipient.
- Providing accurate sender information and legally required disclosures.
- Including and honoring unsubscribe or opt-out mechanisms promptly.
- Maintaining suppression lists and avoiding recipients who withdrew consent.
- Complying with privacy, marketing, consumer-protection, anti-spam, and telecommunications laws applicable to you and your recipients.
- Ensuring your content, attachments, tracking, and personalization are lawful and do not violate third-party rights.
5. Acceptable use
You may not use the Service to:
- Send spam, purchased-list campaigns without a lawful basis, phishing, scams, or deceptive messages.
- Distribute malware or content that is unlawful, abusive, threatening, harassing, or exploitative.
- Impersonate another person, falsify headers, conceal message origin, or mislead recipients.
- Infringe intellectual-property, privacy, publicity, confidentiality, or other rights.
- Probe, disrupt, overload, reverse engineer, or bypass security, access controls, sending controls, or usage limits.
- Use recipient open tracking where it is prohibited or without required notice or consent.
- Help another person do anything prohibited by these Terms.
6. Gmail limits and delivery
MailMex does not remove or expand Gmail limits. Google may throttle, reject, classify, suspend, or otherwise restrict messages or accounts. Delivery, inbox placement, opens, and campaign outcomes are not guaranteed. Open events can be inaccurate because of image blocking, proxying, prefetching, and privacy features.
7. Your content
You retain ownership of content and recipient data you submit. You grant MailMex a limited, non-exclusive license to host, process, reproduce, transmit, and display that content only as needed to operate, secure, support, and improve the Service and comply with law. You represent that you have all rights needed to provide and use the content.
8. MailMex property
The Service, software, website, branding, designs, documentation, and related intellectual property belong to MailMex or its licensors. Except for the limited right to use the Service under these Terms, no rights are transferred to you. Feedback may be used without restriction or obligation.
9. Fees and taxes
The standard MailMex pass costs 5 USDT and provides access for 24 hours from the recorded time of purchase, with an allowance of up to 60,000 MailMex send operations during that window. The pass does not renew automatically unless the checkout page expressly states otherwise. Unused time and sending allowance expire when the 24-hour window ends and do not roll over.
The allowance is a MailMex service limit, not a guarantee that 60,000 messages will be sent or delivered. Actual throughput remains subject to Gmail quotas and policies, connected-account restrictions, device performance, campaign configuration, recipient volume, and network availability. Any taxes, network fees, refund conditions, and additional checkout terms displayed before payment also apply.
10. Suspension and termination
You may stop using the Service at any time. We may restrict, suspend, or terminate access when reasonably necessary to address nonpayment, security risk, legal exposure, abuse, spam complaints, third-party platform requirements, or a violation of these Terms. Where practical, we will provide notice and an opportunity to remedy the issue.
11. Privacy
Our Privacy Policy describes how we handle personal information. You are responsible for providing your recipients with any privacy notice and obtaining any consent required for your campaign and tracking practices.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant uninterrupted operation, error-free output, successful delivery, regulatory compliance of your campaigns, or compatibility with every provider or device.
13. Limitation of liability
To the maximum extent permitted by law, MailMex and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, campaigns, or business opportunities. MailMex’s total liability arising from the Service will not exceed the amount you paid for the Service during the twelve months before the event giving rise to the claim, or USD 100 if you paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless MailMex and its affiliates from claims, damages, penalties, losses, and reasonable legal fees arising from your campaigns, recipient data, content, violation of these Terms or law, or infringement of another person’s rights.
15. Changes
We may update these Terms to reflect changes to the Service, law, or risk. We will post revised Terms, update the effective date, and provide additional notice when required. Material changes apply prospectively. Continued use after the effective date means you accept the revised Terms.
16. General terms
Applicable law governs these Terms and any dispute, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes informally. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. You may not assign these Terms without our consent; we may assign them as part of a corporate transaction. These Terms and any applicable order form are the entire agreement concerning the Service.
